The Prosecutor’s Office Santiago obtained from the First Collegiate Court of this judicial district, a sentence of 30 years of major imprisonment against a man who He tried to kill his neighbor with machetes, whom he harassed and sexually harassed.
The multiple death threats, uttered with expressions such as “one of these days I’m going to kill you”, the constant harassment, and the verbal attacks, culminated in a brutal attack with a machete-type knife against Ruth Esther Peña Guzmán, of 19 years old, by José Ramón Rodríguez Batista, because the victim refused to have sexual relations with him.
The events took place on January 29, 2023 on La Peña street in the Monte Adentro sector, where Rodríguez Batista surprised the woman and, with a machete in hand, brutally attacked her, so neighbors and friends of the victim came out to meet her. , causing the attacker to give up and flee.
Before the attempted murder, the accused, who remained under surveillance, lying in wait for the victim, broke into her residence and struggled with her with the intention of sexually raping her; When the victim refused, the accused slapped her and hit different parts of her body, leaving and once again expressing death threats.
Representing the Santiago Prosecutor’s Office, litigant Yarily Toribio expressed to the court the relevance of an exemplary sentence against the accused, while the risk of death was imminent for the woman.
Based on the occurrence of the events, the Prosecutor’s Office filed criminal charges against the accused for violation of articles 2, 296, 297, 298, 302, 309-1 and 309-3 (letters C and E) of the Dominican Penal Code, modified by Law 24-97 on Gender Violence, which classifies and punishes attempted homicide and aggravated gender violence.
