Guyanese introduce amparo appeal in court for Fospuca case

Fospuca is a waste collection company that calculates its rates according to the square meters of the premises, instead of according to the amount of garbage they generate. Its high rates have generated discomfort in different cities of the country, including the state of Miranda and Lara


Given the lack of institutional response to all the requests and claims that merchants and residential users have made with the Mayor’s Office of Caroní and the company contracted for garbage collection in the municipality, Fospuca, this Friday they went to the Palace of Justice in Puerto Ordaz , to deliver an appeal for constitutional protection.

The measure has to do, not only with the unpayable rates that Fospuca established for merchants and businessmen, but also with the blocking of the page of the Mayor’s Office of Caroní, which prevents taxpayers from paying their taxes, which will result in a fine. .

“We are here to defend ourselves against an attempt to impose the collection of solid waste in the city with a tariff system that compromises the harmony, health, economic and social stability of the inhabitants of the municipality, whether residential, commercial or industrial” , declared Simón Yegres, member of the coordinating commission of the Assembly of Citizens in Caroní for the Management of Urban Cleaning.

He stressed that the businessman wants to pay his municipal taxes, but it is the Mayor’s Office that prevents him from doing so and, in addition, generates a sanction that translates into one more payment that they must assume.

“This amparo appeal is due to the impediment of the Mayor’s Office so that they cannot declare gross income until they cancel Fospuca. By doing that, you put them in a situation where they could get a fine. It’s not the people’s fault that they can’t testify,” Yegres reiterated, adding that there are hundreds of plaintiffs of this appeal and other people can join.

Closing as the only way

For those affected, the only solution they see in the short term if there is no agreement is to close their businesses.

Asdrúbal Sansoneti, from the recycling business sector, expressed his dissatisfaction with the excessive collection of Fospuca.

“This private company is acting as if it were a state company. He gives us rates that we could not reach him by not paying what we pay for rent or by collecting our profits. In my case, it is a rate that I could never pay with the production that I make monthly, ”he explained.

In this sense, he added: “If we do not reach an agreement, we already practically have a way out, which is to give up and close the company. We cannot continue fighting with something that we are not going to find a solution”.

Councilor José Ríos defined the relationship between Fospuca and the Caroní Mayor’s Office as a pairing that “wants to take taxpayers’ money.”

He also denounced that, despite the fact that it is an administrative contract, Mayor Tito Oviedo has not made the contract public and has not told the public “this is what we have contracted as a concession for the urban cleaning service, these are the rates discussed and the laws that regulate it. That is silence that has operated administratively before the requests of the Assembly of Citizens for the Management of Urban Cleaning ”.

On the other hand, Yegres pointed out that the amparo appeal that they filed this Friday in the courts is part of the claims component that they activated since said private company began to bill them. However, he does not rule out other public and citizen actions on the street, if the lack of a timely and satisfactory response continues.

In the same way, those who have several venues must pay for each of them, regardless of whether one is inoperative or empty, since what is taken into account is the size of the venue, and not the waste it generates.

40% of the companies in Ciudad Guayana must pay from 50 to 1,500 dollars a month. From the Caroní Citizen Assembly for the Management of Urban Cleaning, constituted on December 20 by trade unionists and specialists from civil society, they request to meet with the mayor of the Caroní municipality, to be able to raise their concerns. Unions such as Camcaroní and the College of Economists have also raised a series of proposals for an efficient service without suffocating the commercial and business sector.

As for Fospuca’s responses, the company announced to its commercial users with rates above $200, that starting this month of January 2023 they will be able to enjoy a discount of up to 40% on their urban cleaning billing, by expressing their willingness to want to sign a payment agreement with the company, which also includes the sanitary landfill. The latter is charged for the receipt of Corpoelec.

Regarding its performance in the first month of activities in Guayana, the solid waste collection company also announced in a press release that its expectations were exceeded in the Caroní municipality. They assure that in their first month of work they managed to collect 18,286 tons of solid waste.

They emphasize that their operational plan contemplates daily collection on the 37 routes that make up the municipality, the washing and washing of squares and avenues, special days for the attention of improvised boats and the maintenance and care of green areas.
