The sociologist and leader of the Broad Front, Gustavo Leal, filed a complaint against the prosecutor on Wednesday Gabriela Fossati considering that he incurred in a “serious omission” in the performance of his position by not explicitly notifying the Frente Amplista about the crimes for which he is being investigated.
In addition, Leal asks that she be investigated and removed from office for a “contumacious violation” of her duties as a prosecutor. The complaint was based on article 68, paragraph B, of the Organic Law of the Attorney General’s Office, which delimits the cases of serious misconduct.
The accusation of Gustavo Leal
Leal’s defense, led by lawyer Diego Camaño, maintains that Fossati failed in the procedure by not informing his client about the scope of the investigation against him after he went from being a witness to being investigated for the cause of the former presidential custodian. Alexander Astesiano. According to the defense, the prosecutor did not tell him what crimes fell on his defendant and, therefore, he could not defend himself adequately.
Leal’s defense also questions that the magistrate was reinstated just a few days after requesting a 15-day medical leavejust when the Prosecutor’s Office was preparing to decide on the derivations of the Astesiano case on Leal.
Camaño explained at a press conference after presenting the letter that in his 25 years of profession “never” had to denounce a prosecutor.
Leal requests the suspension of the hearing against him
Leal was summoned to testify as a witness after it became known that he had a meeting with the father of Alejandro Astesiano. After that first hearing, Leal was investigated and, as it became known, he was being investigated for a crime of concealment.
Last week, Leal and his lawyers reiterated the request to the Prosecutor’s Office to report on the crimes that he is accused of. At that time, Fossati was certified and the acting prosecutor, Fernando Romano, requested an extension since he had had access to the case for a short time. On Monday, Fossati requested her reinstatement and she was preparing to appear at the hearing this Thursday.
As confirmed by the spokesman for the Supreme Court of Justice, Raúl Oxandabarat, the instance was suspended.
