“We believe that the duty of an important body like the Constitutional Court is to contribute to national unity, so that implies in some way taking certain approaches, which without reaching levels of impunity or exemption from responsibility, do seek measures to be able to integrate a historically divided country,” he said on RPP.

The court also said that the Constitutional Court’s ruling allowed the country to find peace, as it prevented Fujimori from dying in prison or in a hospital.

“I think that the ruling has brought about a climate of calm in the country at this time, and I think that it has been extremely important and that this should call for reflection. Perhaps death should be taken from a positive perspective, in search of better conditions to be able to strengthen a more solid country, safeguarding differences. Different ways of thinking cannot lead us to radical measures,” he said.

Gutiérrez said that he was not surprised that the former president announced his candidacy for the Presidency in 2026. In that sense, he indicated that he was a “political man”: “Obviously it is a difficult subject to classify, but it does seem to me that it is part of an expression of someone who is accustomed to political life. It is like García, it is like Haya de la Torre, it is like those figures who until their last breath will finally express a political position.”

As we recall, in December 2023, the Constitutional Court declared the appeal filed by Alberto Fujimori well-founded. In this regard, it ordered the National Penitentiary Institute (INPE) to order the immediate release of the former president.

The ruling came despite a decision by the Inter-American Court of Human Rights (IACHR), which ordered that the sentence that freed the former president not be executed.
