The president of the Council of Ministers, Gustavo Adrianzén, spoke about the recent approval in Congress which extends by six months the term of the Comprehensive Mining Formalization Registry (Reinfo). In this regard, the head of the PCM pointed out that the Executive has not yet officially received the opinion, but when it arrives, they will analyze it before making a decision. “We are going to review itwe are going to present an opinion, we will review whether it is in accordance with the Constitution. If you agree, we will give our opinion and, if appropriate, promulgate it, we will do so; and if it is appropriate to observe it, we will also follow that path,” he expressed.

Adrianzén, during an interview on RPP, highlighted that the expansion of Reinfo was not included in the legislative proposal presented by the Executive on the Small Mining and Artisanal Mining Law (ASM Law), currently under debate in the Energy and Mines Commission congressional. “In that law This is not an extension of the Reinfobecause it was not what corresponded nor did it correspond to the mandate that we received from Congress itself,” he added.

“I have been able to appreciate that with a ordinary law of Congress intends to make modifications to the basic law of centralization and the law of local governments,” explained the head of the ministerial cabinet, questioning the scope of the law approved by Congress. In addition, he warned that these provisions could “restrict powers or powers that have already been conferred to the regional mining directorates”.

Congress approves extension of Reinfo for 6 months

On the night of Friday, November 29, the Plenary Session of Congress approved a new law that extends for six months the term of the Comprehensive Mining Formalization Registry (Reinfo), allowing the Executive to extend this period for another six months through a supreme decree. The rule establishes that the formalization process for small and artisanal mining will have a deadline of June 30, 2025, with the possibility of a single extension until December of that year.

One of the most debated aspects was the centralization of powers in the Ministry of Energy and Mines, eliminating the role of regional governments in formalization processes. The law also incorporates the creation of the Interoperable System for Small Mining and Artisanal Mining, designed to supervise the traceability of minerals, chemical inputs and related products, interconnecting the ministry with entities such as SUNAT, the Police and the Financial Intelligence Unit. This measure seeks to improve the supervision of mining activities and guarantee greater transparency in the sector.

However, the approved norm has generated controversy due to the omission of key reforms. Congress avoided repealing a clause in legislative decree 1293 that allows illegal miners to operate in prohibited areas, which indirectly benefits illegal mining. Despite requests from legislators such as Ruth Luque to include this modification, it did not obtain support. Now, the focus will shift to the debate on the Small Mining and Artisanal Mining Law, with the goal of consolidating the formalization of the sector in the next twelve months.
