The regulations include the mandatory minimal requirements for inclusion or permanence in the pre-pension list in accordance with the articles 12 of Law 379-81 and 66 of Law 41-08; he procedure for the process of automatic pensions, according to Articles 1 and 7 of Law 379-81.

“This regulatory instrument establishes, in a clear and unified way, the administrative procedures for the application, inclusion and permanence in the pre-section payroll, as well as the mechanisms for the granting of pensions under the Law 379-81. This means that, from now on, our processes will be more agile, clearer and more fair, eliminating unnecessary obstacles and guaranteeing that each worker receives his pension in the time that corresponds to him, as provided by the law, ”said Rosa.
Requirements for inclusion
The document reviews that the minimum requirements for the inclusion of a public servant in the pre-section is the server’s pension request duly signed and received by the DGJP; the Certification of the institutions where it has provided service that support the provision of the years required (if applied); the certification of the DGJP that the public servant is in the state cast system; The application return from a Individual capitalization account (CCI) of a pension fund manager (AFP) to the distribution system deposited with the Inter -institutional Commission created by the National Social Security Council (CNSS) by resolution, via the General Directorate of Information and Defense of Social Security Affiliates (DIDA).

Public servants who meet the requirements indicated in Law 379-81 must deposit before the public entity or body to which they belong, all the documents that are requested so that its owner can initiate the procedures corresponding to the pension or retirement, in which case it will not be considered initiated, until the corresponding documents are deposited; So the server that does not comply with the contribution of the required documents must continue to assist in a timely manner compliance with its obligations.
“The pension application by a collaborator must be received in a mandatory manner by human resources and the institution will respond in writing of any observation in it, and must leave a copy of all this in the Human Resources file of the collaborator for audit purposes,” says the resolution.
Right to retirement
The retirement of public servants, in accordance with the provisions of Law 379-81, is automatic when more than more than 30 years of services, with 60 age or at more than 35 years of services, without taking into account age.
