Government formalizes tightening of the penitentiary system

He Executive power published this Wednesday Supreme Decree No. 019-2025-JUS, which modifies the Regulations of the Criminal Execution Code with the aim of reinforcing the special closed regime in the criminal.

Days before, government officials indicated that there was the intention to rationalize the visitation regime, reinforce internal discipline and prevent the entry of prohibited objects as part of the guidelines of the National Penitentiary Policy for 2030.

The norm, published today and endorsed by President José Jerí and the Minister of Justice, Walter Martínez, establishes new provisions for stages A, B and C of the special closed regime, with more severe restrictions on access to visits, patio hours and internal circulation of inmates.

Changes in the prison regime

According to the decree, inmates in Stage A, considered the most difficult to readapt, will only be able to access two hours of yard time per day and receive a biweekly visit from a family member, under strict conditions.

“A visit every two weeks by a maximum of 1 relative by consanguinity up to the fourth degree or affinity up to the second degree, men or women, including the spouse or common-law partner,” the standard indicates.

The visit will last 1 hour and is done through a call center. In addition, it is established that the cells will remain closed in an unfailing manner, prohibiting transit through passageways.

In the Stage B regime, the rigor of inmate discipline and surveillance is maintained, making it compatible with greater promotion of family ties. These inmates may receive a visit every two weeks from a maximum of two relatives by consanguinity up to the fourth degree or affinity up to the second degree, male or female, including the spouse or common-law partner. The duration of the visit is two hours and is carried out through a call center.

Inmates under this regime will be able to go out to the yard for up to three hours, between 9:00 a.m. and 6:00 p.m.

Finally, the Stage C regime allows inmates to be in the yard for up to four hours a day. Like the Stage B regime, a visit is allowed every two weeks for a maximum of two relatives by consanguinity up to the fourth degree or affinity up to the second degree. However, the visit time is increased to three hours.
