The Ministry of the Interior denied that the lawyer of its Legal Division Ignacio Sapiain, appointed as plaintiff in the open case of the Public Ministry against the leader of the CAM, Héctor Llaitul, defends him in the framework of the Hurricane case, where he appears as a victim.
As reported The bookcasebefore the error that excluded the portfolio from that investigation, the lawyer applied a procedural maneuver where he requested to continue participating in “representing the victims” of the assembly of evidence on attacks in the southern part of the country, prepared by ex-carabineros.
Although the accusation of the Interior was deemed not filed, the Temuco Guarantee Court determined that “in any case, he still has the status of representative of the victims and precisely in that capacity the complaint was filed, as a consequence of this, notwithstanding not being an accuser, this court considers that he may continue as an intervener in the sole capacity of victim”.
Likewise, the aforementioned media outlet maintains that during his speech at the hearing on Thursday – which concluded with the preventive detention against Llaitul -, Sapiain maintained that the accused “is a leader, much more than a warrior, and we can empathize in some aspects with his cause referred to the territorial claim, but as a good leader he has lost his way, he has not realized the damage he is causing to his own people”.
In response, the Ministry’s Legal Division assured that “the statement that the Ministry of the Interior and Public Security represents Mr. Héctor Llaitul in the framework of the investigation of the Hurricane case is completely false. The Government does not represent natural persons who are victims of the crimes investigated in the framework of that investigation, which includes Mr. Llaitul”.
“The Ministry of the Interior represents Chilean society that has been the victim of a serious case of violation of the rule of law, such as the Hurricane case, where evidence was falsified. All cases need justice,” they added, stating that the leader of the CAM is indeed a plaintiff in that case, “and in that capacity it has its own legal representation.”
