In a report published this Saturday by a local media, Decree SP/940 dated June 21, 2021, signed by the Secretary of the Presidency of the Republic, Dr. Alvaro Delgado, is disclosed, where it is established that the decision it is for “for reasons of urgent need that cannot be postponed, which are understood to be justified”.
The presidential document mentions the decrees 93/020 and 104/020 of March 2020 when the state of national health emergency was established in our country, in which the entry into the country of foreign citizens from any country is expressly prohibited, except for some exceptions established in article 2 of the decree 104/020within which the entry of capillary doctors to treat government officials is not included.
Likewise, the document signed by Dr. Alvaro Delgado clarifies that according to the Decree No. 16/021the President of the Republic acting in the Council of Ministers “will authorize the entry into the country of those persons who are covered by any of the exceptions established in Article 2 of Decree No. 104/020.”
The presidential resolution concludes considering “that exceptional entry into our country is requested for reasons of urgent and urgent need, which are understood to be justified” and acting in the exercise of delegated powers, the secretary of the presidency RESOLVES:
«1°.- Except from the prohibition established in article 2 of Decree No. 104/020, of March 24, 2020 in the wording given by article 1odel Decree No. 159/020dated June 2, 2020, to Messrs. Andrea Acciarri, holder of passport number YA7222059 and Bruno Szyferman, holder of DNI No. 25,682,327.”

The report also includes immigration documents from Argentina where it is stated that surgeon Bruno Szyferman entered Uruguay by car through Gualeguaychú on June 25, 2021 at 7:48 p.m. and returned to his country on June 28 in Buquebús from the port of Montevideo.
The local media also reports that the specialist would have already come to Uruguay in May 2020 at a time when the national health emergency was also underway and the entry of foreigners into the country was prohibited. The investigation managed to confirm this fact through Szyferman’s Instagram account in which his stay in Montevideo on June 1, 2020 was verified.
In another part of the article, it is concluded that the exceptional permit granted by the presidency to the specialist in the midst of a pandemic does not explain the reasons for such a decision and that it violates current legislation, according to the Law No. 19,823 of the Code of Ethics for Public Function, which establishes that public officials must, in exceptional cases, always base their decisions and explain “the reasons of fact and rights that support it. General formulas of justification are not admissible, but a direct and specific relationship of the facts of the specific case in resolution must be made, also stating the reasons that, with reference to it in particular, justify the decision adopted.” “In the case of discretionary acts, it will be required the clear identification of the reasons on which the option is based, in consideration of the public interest”, adds the law, and in no paragraph of the presidential decree is it mentioned that the doctor came to treat the president’s scalp.
The investigators who carried out the report also affirm that Dr. Szyferman was contacted by telephone “who said he could neither confirm nor deny the information and that he was obliged as a doctor to maintain professional secrecy about his patients.”
Article 2 of decree 104/020 on the prohibition of entry of foreigners in Pandemic
“The entry into the country of foreign citizens from any country is prohibited, except for: a. Foreigners residing in the country. b. Aircraft crews and ship pilots. c.
