PT, PSB and PSOL leaders entered this Thursday (18) in the Supreme Court (STF) with an action to suspend the process of amendment to the Constitution (PEC) that restricts the opening of investigations against deputies and senators.
In the writ of mandamus sent to the Supreme, the parliamentarians claim that it is called PEC of the Armage, approved on Tuesday (16)did not follow the proper rite and violates the internal regiment of the house and the constitution.
The parties question the lack of submission of amendments within the regimental period and prior advertising of the opinion of the rapporteur, in addition to the convening of the deliberation sessions without minimal in advance to vote on the proposal.
In the understanding of the parties, the irregularities in the processing of the PEC must be remedied by the Court.
“The continuity of the processing of PEC 3/2021 may consolidate insatiable addiction, making the damage to due legislative process irreversible. If the process reaches approval in two shifts, the approved text will be sent to the Senate appreciation, and the amendment may become integrating the constitutional text, making it difficult or even making the reversal of its effects,” the parties argue.

After the approval of the PEC, the article was sent to the Senate. In case of approval, the proposal will be promulgated by Congress and will come into force.
The PEC states that any opening of criminal prosecution depends on prior authorization, in a secret vote, the absolute majority of the Senate or the House. In addition, the proposal grants forum in the Supreme to party presidents.
