Goodyear employees at SLP accuse imposition

“Mexico is highly vulnerable to climate change”;  call for a common front

Workers from the Goodyear company in San Luis Potosí denounced that the company intends to impose a collective labor contract on them. protectionsigned with a CETEM union, and disregarding the contract law of the rubber industry that governs labor relations in the sector.

The Liga Sindical Obrera Mexicana (LSOM) provides advice and accompaniment to the workers of the plant, who warned that they could resort to the Rapid Response Labor Mechanism of the T-MEC, in case their rights be violatedas it is a priority sector.

The case was exposed in a letter to the main labor attaché of the United States in Mexico, Pablo Solorio, and to the director of the Federal Center for Conciliation and Labor Registration, Alfredo Domínguez.

Emiliano Sánchez, special delegate of the LSOM section Goodyear SLP, indicated that the collective contract (CCT) dates from April 15, 2015, when there were no employees yet nor had the first stone of the plant been laid.

The tire company, he said in an interview, signed behind the workers’ backs a CCT with the Miguel Trujillo union, affiliated with the CTM, which recently lost its contract at General Motors in Silao, Guanajuato.

The application of the contract law, as has been indicated, is an obligation for Goodyear, but it has tried to evade it through the singular agreement that it signed with Tereso Medina. Although it is an illegality, because there can be no agreement that annuls compliance with the legal obligationpointed out Gonzalo Israel Soto, also a delegate of the union league.

Francisco Retama, political adviser to the LSOM, explained that one of the ways in which the company seeks turn it around to the contract is signed by the CCT. Also, he said, through insourcing, which implies the creation of different company names within the company.

He pointed out that a legal contract applies to all workers of companies in a certain industrial branch, signed by employers and a group of unions.

He added that the legislation establishes that if there is a legal contract in the branch, the CCT cannot be registered by the authority. However, he indicated, he was enrolled by institutions of the old labor system and now they try to keep giving it life by subjecting it to the legitimation process, in alleged compliance of labor reform.

The LSOM indicated that the CCT was modified in the years after 2015, until it became the set of labor relations that govern all unionized people who work at Goodyear, although never exceeding the working conditions established in the contract law.
