Gilberto Bátiz protests as the new president of the Electoral Tribunal

Despite everything, due to lack of evidence or due to improper assessment by the National Electoral Institute (INE), the plenary session of the TEPJF resolved to revoke the sanctions, for 66 thousand pesos, with the majority vote of the magistrates, and Bátiz’s excuse for not participating in the resolution of the cases in which he was a party.

Bátiz García participated in the election last June and with 4.7 million votes received, just 18.37% of those cast in the judicial election to elect electoral judges, he was the most voted, which is why he assumed the position of presiding judge today.

It would be a new phase of the TEPJF, since from 2019 to 2025 four judges who were not elected to the position have held the presidency: judges Felipe Alfredo Fuentes Barrera, José Luis Vargas Valdés, Reyes Rodríguez Mondragón and Mónica Soto.

Upon assuming the presidency, Bátiz explained the axes in which he will exercise his presidency: teamwork with his colleagues and direct contact with people, under the premise that “what is not known is not valued, and what is not valued is not defended.”

Justice, he stated, “should not remain enclosed within walls or files, but rather should travel through the territory, listen out loud, explain its decisions and strengthen civic education, especially among historically discriminated and vulnerable groups.”

Bátiz García, originally from Chiapas, stated that in a country with complex internal and external challenges, electoral justice must be a pillar of social peace and democratic certainty.

“Electoral constitutional judges have, in addition to a legal obligation, a republican responsibility to conduct themselves with a vision of the State that allows the transmission of power in a legal, legitimate and conflict-free manner,” he said.

He recognized that the Judicial Reform of 2024, together with the ongoing electoral reform, requires a readjustment of the administrative apparatus of electoral justice and with this in mind he said that he will be sensitive to the conditions of the country and responsibly review any budget adjustment that strengthens the rationality of spending without compromising judicial independence.

In his message he indicated that applying the law in San Pedro Garza García is not the same as in San Pedro Chenalhó, pointing out that the rules are the same but the social conditions are different, and justice must understand these differences in context.

Bátiz took office as the new president of the Court in a solemn session attended by the presiding minister of the Supreme Court of Justice of the Nation, Hugo Aguilar Ortiz, and members of the Judicial Disciplinary Court.

In his participation, Minister Aguilar Ortiz pointed out that a fundamental pillar of democracy is the guarantee that elections are free, that votes are counted correctly and that there are institutions that guarantee that differences or conflicts that arise during the process are resolved by a specialized, impartial and now democratic entity.
