The government is preparing changes in the social name and gender fields of the National Identity Card (CIN), a standardized document that intends to replace other forms of citizen identification, such as the famous RG, which is issued by state secretariats.
Through a resolution published in Official Diary of the Union this Monday (10), the Federal Executive Chamber for Citizen Identification created a working group composed of representatives from five ministries, in addition to the Federal Revenue Service and the National Council of Directors of Identification Bodies. The objective is to propose changes to the current rules, which were established in February 2022, in the government of Jair Bolsonaro.
In November, the Federal Prosecutor’s Office for Citizens’ Rights (PFDC), an agency of the Federal Public Ministry (MPF), issued a technical note criticizing the decree that established the current rules. The text foresees, for example, the inclusion of the registration name next to the social name field.
For the PFDC, the provision for the inclusion of the registration name in the CIN “not only constitutes a flagrant violation of the right to self-identification of the trans person, but also invalidates their own need for use, in addition to opening a dangerous precedent for the vexatious exposure of a name who does not represent the person you wish to identify”.
The agency also stated that “the requirement to include biological sex, in addition to not containing any administrative or bureaucratic need that justifies it, encourages violations of the human rights of people who present a registered sex different from their identity and gender expression”.
A draft to change the provisions on the gender and social name fields in the National Identity Card must be submitted within a maximum of 60 days, according to the decree published this Monday (10).
