Minister Luiz Fux of the Federal Supreme Court (STF) voted This Wednesday (10) for the acquittal of former Justice Minister Anderson Torres (photo)one of the defendants of the crucial core of the attempted coup d’état in the government of former President Jair Bolsonaro.
Due to the minister’s statement, Torres should not be convicted of crimes of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, coup, damage qualified by violence and serious threat and deterioration of listed heritage. The penalty could reach 30 years in prison.
Despite Fux’s understanding, The score for the condemnation of Torres, Bolsonaro and six other defendants is 2 votes to 1. The votes for the conviction were delivered yesterday (9) by the ministers Alexandre de Moraes and Flávio Dino.
During the investigations, the Federal Police (PF) found at the home of Torres the document called the “scam draft”.
For Fux, the former minister was not close to the military and there is no evidence that he would have adhered to the attempted coup.
“There is no document, image and video that the defendant planned the abolition of the Democratic Rule of Law,” said the minister.
The former minister was also accused by the Attorney General’s Office (PGR) of being absent from the Federal District amid the scammers of 8 January. On the day of the attacks, he held the position of Secretary of Security of the DF, but was on vacation in the United States.
In Fux’s understanding, Torres warned in advance to the Governor of the Federal District, Ibaneis Rocha, who would be on vacation and, moreover, the responsibility of policing was the commander of the Military Police, not the then secretary.
“There was no planned omission,” he said.
Fux also countered the accusation that Torres, as Minister of Justice, ordered special operations by the Federal Highway Police (PRF) to block the displacements of voters of President Lula in the Northeast, during the second round of the 2022 elections.
“There is no concrete proof of direction to be reached voters from the current president,” he added.
The minister continues his vote, which already lasts 12 hours.
