Minister Luiz Fux of the Federal Supreme Court (STF) voted on Wednesday for the acquittal of former Navy commander Almir Garnier, one of the coup plot’s defendants to reverse the result of the 2022 elections.
The minister rejected the prosecution of the Attorney General’s Office (PGR), who asked the Supreme to convict the crime of armed criminal organization, attempted violent abolition of the democratic rule of law, coup, damage qualified by violence and serious threat and deterioration of overturned assets.

According to the complaint, Almir Garnier attended a meeting in which the former president presented minutes with studies to decree exception measures. The idea would have been rejected by the aeronautics and army commanders.
The PGR also pointed out that the admiral refused to transmit the position to the new commander appointed by the government of President Luiz Inacio Lula da Silva.
In Fux’s understanding, the military did not commit enforcement acts and that the mere presence in meetings is not sufficient for the conviction.
“The conduct narrated in the complaint and attributed to the defendant Almir Garnier is far from corresponding to a member of criminal association,” he said.
The minister continues his vote and analyzes the conduct of the other defendants.
