THE minister Luiz Fuxof the Federal Supreme Court (STF), requested a review of the appeal in which senator Sérgio Moro (União-PR) intends to overturn the decision that made him a defendant for the crime of slander against minister Gilmar Mendes.
With the request for more time to analyze the case, the virtual trial was suspended and there is still no date for it to be resumed.
Until now, the trial score is 4 votes 0 for rejecting the appeal of the senator.
The votes were given by the rapporteur, minister Cármen Lúcia, and ministers Cristiano Zanin, Alexandre de Moraes and Flávio Dino.
In June last year, Moro became a defendant in the Supreme Court after being denounced by the Attorney General’s Office (PGR).
The complaint was made based on a video in which the former judge of Operation Lava Jato appeared in a conversation with unidentified people during a June party, which took place in 2022, and stated: “This is bail, an institute to buy a habeas corpus by Gilmar Mendes”.
Other side
During the trial in which the senator became a defendant, lawyer Luiz Felipe Cunha, Moro’s representative, defended the rejection of the complaint and said that the parliamentarian had publicly recanted.
To the lawyer, Moro used an unhappy expression.
“An unfortunate expression recognized by me and by him as well. In a joking environment, in a June party atmosphere, on an uncertain date, my client made a joke talking about the eventual purchase of his freedom, if he were arrested in that June party joke circumstance.”
