Future minister Marcela Hernando responded to the vice president of Enami: "The entire process suffers from legal flaws" so she is going to "go to court"

The future Minister of Mining, Marcela Hernando, responded to the executive vice president of the National Mining Company (Enami), Enrique Valdivieso, regarding the bidding process for a series of properties owned by the state entity, to which the executive referred to the postponement of the contest “as much as possible”. In relation to Hernando’s (PR) reaction, he said: “Not being satisfied with the response that he sent me, I am obliged to seek protection in the courts of justice since, in my opinion, the entire process lacks of vices of legality”, pointed out the parliamentarian.

The still deputy for the Radical Party sent a letter to the company requesting information regarding the alienation process, on February 11 and returned to retruck the auction. This, after not being able to clarify all the points that she previously objected to, which is why she in her response letter, to which she had access Biobioin which, according to what was announced by the vice president of the state company, Hernando pointed out contradictions in the information he received from the company.

“I have to say that some of the phrases in your letter are absolutely incomprehensible, since saying that ‘the auction process for any asset is not effective’ to immediately affirm that ‘what is being carried out is a bidding process for assets expendable’, it is frankly incomprehensible”, stated the text.

Added to this, the objective of the future Mining Minister is that the asset manager Tattersall be given the instruction to “cancel the entire process. This is because I believe that this process does not comply with the law, it was not approved by the board of directors, as the minutes of last October 28 clearly state.”

Added to this, he questioned the apparent improvisation of the contest. “If one goes to the Tattersall page, and looks for the bases, a notice is displayed indicating that they are in the approval process, how is it possible that 20 days after the end of the bidding process, the bases are still in the approval process? preparation?” the next purse holder wondered.

The tender for Enami’s corporate building located on Mc Iver street, in the Santiago commune, is postponed because the vice president argued that it is underutilized, to which Hernando argued that “it is inexplicable that it wants to be sold at a fifth of its value commercial and even at a value lower than its fiscal appraisal”.

It should be remembered that last Wednesday Hernando filed an appeal for protection before the Court of Appeals of Santiago seeking to leave “without effect” the bidding for the real estate, which has not yet been declared admissible.
