The Subcommittee on Constitutional Accusations of the Congress approved the final report of the constitutional complaint against the suspended parliamentarian Freddy Diazwhich recommends that the legislator accused of rape be disqualified from public service for 10 years for violating four articles of the Magna Carta.
“It has been shown that the denounced congressman misused his power as a congressman and his investiture to have sexual relations and drink liquor with a worker who is under his charge, causing psychological damage to her using the facilities and public resources assigned to him by Congress”, reads the final report prepared by the acciopulista Luis Aragon.
The document was unanimously approved with 19 votes in favor.
After supporting the final report, the parliamentarian Susel Paredes, who described the case as “emblematic” because a violation of freedom is sanctioned: “Before, rape was considered a crime against honor. After a lot of work by criminal lawyers, progressives and the women’s movement, it was made a crime against sexual freedom”.
The apepista also participated Maria Acuna, who was in favor of the disqualification of his former bench partner. He pointed out that the psychological and physical damage, and whether the relationship was consensual or not, will be determined by the National Prosecutor’s Office.
Ratification
Once the final report is approved by the Subcommittee on Constitutional Accusations, the document must be ratified by the Permanent Commission and the plenary session of Congress.
For disqualification to take place, a vote in favor of 2/3 of the number of members of Congress is required, without the participation of the Permanent Commission. In the event that Freddy Díaz is out of bounds, his accessory Nelcy Lidia Heidinger Ballesteros enters.
