The visiting minister, Romy Rutherford, prosecuted the former commander-in-chief of the Army, Óscar Izurieta Ferrer, as the author of embezzlement of public funds and forgery of a military document, for the use of reserved expenses of the institution.
The magistrate held, at this procedural stage, the general (r) responsible for the misuse of funds allocated to the institution for a total amount of $6,374,996,162, updated to date and corresponding to the period between March 2006 and March 2010 .
Rutherford also ordered seizure of assets for a total amount of $6,500,000,000 and ordered Izurieta to be placed in preventive detention in the Peñalolén Military Police Battalion; where he entered last Thursday after being questioned by the magistrate.

According to the resolution, Izurieta is recognized as “the perpetrator of the repeated crime of embezzlement of public funds that article 233 provides for and punishes in connection with article 238, both of the Penal Code, perpetrated between March 2006 and March 2010, related to a total damage caused to the Chilean Treasury amounting at the time of the events to the sum of $3,975,900,659 and equivalent to 116,166.7 UTM, which currently corresponds to the sum of $6,374,996,162”.
It is specified that the retired military officer is also prosecuted for the repeated crime of falsifying a public document that provides for and punishes article 367 number 5 of the Code of Military Justice in connection with article 193 number 4 of the Penal Code, “related to the rendering of accounts, sworn statements and their annexes, regarding the reserved expenses corresponding to the budget years of the years 2006, 2007, 2008 and 2009 that were sent to the Comptroller General of the Republic at the time”.

It should be remembered that Judge Rutherford questioned the former commander-in-chief of the Army throughout the day on Thursday, after which the general (r) entered the Peñalolén Military Police Battalion.
The investigation is within the framework of the so-called “fraud of the Army”, where Rutherford has already prosecuted the generals (R), Juan Miguel Fuente-Alba and Humberto Oviedo, in addition to the former colonel, Mauricio Orlando Seguel Albornoz. Izurieta was the only highest authority of the military institution who had not been prosecuted.
