At the proposal of Norma Lucía Piña and with the support of seven ministers, the plenary session of the Supreme Court of Justice of the Nation (SCJN) decided to join the workers’ strike against the reform of the Judicial Branch of the Federation (PJF).
Ministers Yasmin Esquivel, Loretta Ortiz and Lenia Batres, who voted against and rejected the measure adopted by Norma Piña, Javier Laynez, Juan Luis Gonzalez Alcantara, Ana Margarita Rios Farjat, Alfredo Gutierrez Ortiz Mena, Jorge Mario Pardo Rebolledo, Luis Maria Aguilar and Alberto Perez Dayan.
According to information from PJF officials, during the private session, Minister Piña Hernández, in her capacity as president, called for a vote, and once she had majority support, she rejected the arguments of Ministers Batres, Esquivel and Ortiz, who demanded that work continue because the law does not allow the Court to suspend activities, and they also did not validate their arguments that with this suspension the Judiciary practically stops providing services that are important to society.
After decreeing the suspension of activities, the Court announced that it will address matters that are considered urgent and that it will find the way of holding a session if necessary
and was limited to indicating that There are international treaties and conventions that grant the right to demonstrate or to a suspension, such as the one we are experiencing now.
.
The plenary session was suspended again – for the fifth time in August to date – and the plenary decided to join the strike in support of the actions of the PJF employees.
Ministers Batres, Ortiz and Esquivel considered that the ministers who approved the strike could be dismissed through impeachment and would face administrative sanctions for their actions.
Hours later, to justify their actions, the ministers who voted in favor of the strike issued a document in which they emphasized that they acted in accordance with the Constitution
their convictions and Given the atypical and extraordinary situation that the Federal Judicial Branch (PJF) is going through
.
They “deeply regretted the disqualifications, slander and threats contained in the pronouncement set made public by the minority, directed against the ministers who make up this majority, but above all, against the workers of this Branch of the Mexican State, including the heads of the federal jurisdictional bodies of our country who, like any person, have the freedoms of expression, association and assembly, recognized by international human rights law and our constitutional law.”
Through its statement, the majority group pointed out that The administration of justice continues with the processing and study of the matters, as well as the attention to urgent cases. The Supreme Court of Justice of the Nation, bastion and last line of defense of the fundamental rights of all people, is, and must continue to be, an example in the recognition and promotion of human rights, without this implying the undermining of the guarantees of the people who work in this Institution.
