The fiscal Gabriela Fossati recognized that did not read all the chats that are part of the investigation of the Astesiano case, for which he reached an abbreviated agreement with subsequent conviction for the former head of custodians of President Luis Lacalle Pou.
Fossati was interviewed by Gabriel Pereyra on the VTV program En la mira and when asked if she had read all the chats and seen all the graphic records that are part of the investigation on Alejandro Astesiano, she replied: “We use keywords to reach all the people who could be related. Everything was impossible because there were 144 thousand pages“.
The magistrate affirmed that she worked with different context teams (to analyze the information) and that she asked them to have a “general view” of everything that was part of the case. However, he recognized that this term “he had to runbecause it didn’t arrive on time.
“The reality is that context work I can’t control it because we work at the same time on other tasks. We filtered by keywords everything linked to people who worked around Astesiano, with people who were mentioned by him, people who shared the work environment, public officials at all levels… We have carried out a name filtering process. I think we have included the names of all the heads of the ministries,” explained Fossati, head of the 12th shift Flagrancia prosecutor’s office.
When asked if “surprises” could appear in the remainder of the investigation, especially at the level of political authorities, the prosecutor replied: “I think we will not have surprises.”
Criticism of the agreement with Astesiano
Fossati referred to the criticism he received after the decision to enter into an abbreviated agreement with Alejandro Astesiano. For the magistrate to go to oral and public trial “It wouldn’t have been the best way.”.
“I think that Astesiano is not the monster or the person who serves as an example of the worst in Uruguay. He is a person who was wrong many times, he is a person who took advantage of a place where he was, he is a person who was clearly eager to receive proposals that benefit him,” he said.
“Taking it to trial could be a way of reifying it, of using it as an instrument to deliver a message. It seems to me that there are inks of legal literature in the sense that we have to be very careful in respecting and managing the people who are subjected to to criminal proceedings. It would have been dehumanizing him,” he added.
After that reflection, Fossati wondered: “Are we going to want shows legal or apply more dignified strategies for human beings?
The complaint against Pereira and the accusations of “white”
Consulted about the complaint that she presented days ago against Fernando Pereira, Alberto Grille and users of social networks for defamation and insultsFossati said that he had to define if he was going to “whether or not to tolerate disrespect”.
The magistrate explained that she decided to file the complaint after learning that her colleague, the prosecutor Fernando Romano, had decided to act ex officio in response to a comment from a lawyer on social networks that she called “primate” to the president of the prosecutors union, Willian Rosa.
“it didn’t happen with me“, Fossati expressed in relation to the possibility that another prosecutor would take ex officio the grievances that he affirms received.
“There is always the one who is located from a place and selects those who are related and who is on the opposite side,” he added. After that reflection, the journalist ironized that Fossati was “white”.
It was then that the prosecutor laughed and noted: “That’s what you say“. And she recalled: “I have been a magistrate since 1993. I was a judge from 1993 to 1999. Since 1993 I have not made a political statement, I have not stepped on a political act. My children were never allowed to put a political banner on my house or on my car. I would like to know who has resisted an archive since 1993”.
