The seventeenth federal labor court of individual matters in Mexico City ordered the National Autonomous University of Mexico (UNAM) to pay the retirement bonus and return the unjustified withholdings
that they applied to the woman, who concluded her working life in that department.
The Federal Judiciary Council reported that a former worker sued UNAM for payment of the difference in retirement bonuses and the return of discounts made by the institution at the time of paying her the bonus.
He indicated that the former worker argued that to determine the amounts of the bonus, a salary that did not correspond to her biweekly salary was taken into account, so she had the right to claim the differences in said payment. He also requested payment of discounts and withholdings made by UNAM for loans.
The district judge specialized in labor matters Antonio Ordóñez Serna indicated that the UNAM did not justify the origin or origin of various withholdings, so the discounts it made are illegal and contrary to article 110 of the Federal Labor Law.
He also indicated that the retirement bonus for administrative workers must be calculated based on the integrated salary, as established by the jurisprudence issued by the Supreme Court of Justice of the Nation.
Ordóñez dismissed allegations of lack of action and right, and those of non-existence of debt. The resolution of the seventeenth court confirmed the right of the former worker to claim payment of her bonus.
