The former general director of Carabineros (2018-2020) Mario Rosas sent a request to the Central North Regional Prosecutor’s Office to marginalize the prosecutor Ximena Chong, in charge of the case that investigates the role of the Carabineros in human rights violations during the social outbreak. In Rozas’ opinion, Chong does not give guarantees of impartiality.
According to Thirdthe request – made through the lawyer Carlos Cortes, representative of the former general director of Carabineros – points out that the persecutor should be disqualified from the case because she is part of the Association of Feminist Lawyers (Abofem). Chong is a member of the organization’s advisory council.
Abofem was the one that started the criminal case known as “command responsibility”, through a complaint filed in April 2021.
Rozas’ petition indicates that the persecutor “has an active participation in ABOFEM, which is additionally reflected in various actions in conjunction with other prominent members of the association.”
Likewise, the text indicates that “prosecutors must always adapt their actions to an objective criterion, there being causes of inability for the case that concur – not in degree of certainty but of presumption – antecedents that remove objectivity.”
Chong “is disqualified for subjective reasons (close friendship with ABOFEM and its partners), as well as objective reasons (being a member and Consulting Director of ABOFEM)”, adds the document.
The text is addressed to the Central North Regional Prosecutor, Xavier Armendariz, who named the persecutor Chong in the case. This, after the national prosecutor, George Abbottwill assign the case to that jurisdiction in February of this year.
