The lawyers of former Defense Minister Paulo Sergio Nogueira presented this Monday (24) a new appeal to the Federal Supreme Court (STF) against conviction in the criminal action of the coup plot.
Army Reserve General, Nogueira was sentenced to 19 years in prison and again asked for acquittal. Furthermore, The soldier’s lawyers pointed out an error in calculating the sentence.
According to the defense, if there is a decision to maintain the conviction, the penalty to be set should be 16 years and four months in prison.
“Despite the high level of legal knowledge contained in the ruling, some points, with due respect, remained unclear, and, in fact, some issues raised in the clarifications were not subject to analysis”, argued the lawyers.
The appeal will be analyzed by Minister Alexandre de Moraes, rapporteur of the case.
According to the Attorney General’s Office (PGR), responsible for the complaint, the general was accused of endorsing criticism of the electoral system, instigating the coup attempt and presenting a version of the coup decree to ask for support from the commanders of the Armed Forces.
On the 14th of this month, the First Panel of the STF upheld the conviction of Nogueira, former president Jair Bolsonaro and other people convicted in the criminal action of Nucleus 1 of the coup plot.
With the publication of the ruling, Bolsonaro’s defenses and those of his allies must present new resources to try to avoid arrests to begin serving the sentence.
The deadline ends today at 11:59 pm.
