Formal prison court confirms owner of Ficrea

A federal court confirmed the order of formal imprisonment that was issued against Rafael Antonio Olvera Amezcua, imprisoned in the Reclusorio Sur, for crimes of operations with resources of illicit origin (in the form of having transferred resources from national territory abroad) and organized crime, related to one of the four criminal proceedings that were initiated against him in the case of the Sociedad Financiera Popular Ficrea.

Olvera Amezcua faces the accusations against him for the crimes of organized crime and operations with resources of illicit origin for more than 200 million pesos, related to the illegal purchase of 11 properties that were acquired with money from savers.

The Federal Public Ministry has prosecuted four files, which is why arrest warrants were released against Olvera Amezcua, all from judges based in Mexico City.

In addition to these accusations, the former owner of Ficrea faces federal justice for having defrauded the clients of this credit institution for more than 3,400 million pesos.

According to the ruling, the federal court declared the arguments of Olvera Amezcua’s defense unfounded, which stated that the transfer information was obtained in violation of banking secrecy, because it was not preceded by a court order.

However, the court determined that the credit information requested by the Attorney General’s Office (FGR) should not be preceded by a judicial authorization.

In addition, it determined that the principle of presumption of innocence was respected, since it is not noted that he was treated as guilty of the attributed behaviors.

According to the inquiries and evidence provided by the Public Ministry, from July to October 2014, Olvera Amezcua, through an intermediary, transferred resources of illicit origin from national territory abroad for one million 790 thousand euros, which, converted At the exchange rate of the day of the operation, they are equivalent to 31 million 105 thousand pesos.

Likewise, from June 2013 to November 2014, it transferred resources of illicit origin for 11 million 930 thousand euros, equivalent to 210 million 420 thousand pesos.
