Audience. Before the Appeals Chamber, the Prosecutor’s Office supported the reasons why the leaders of the Front for the Defense of the Rights of the People of Ayacucho were arrested.
The provisional superior prosecutor Luis Javier Ramírez Cancho sustained before the Third National Criminal Chamber, made up of judges Emeritus Salinas Siccha, Víctor Enríquez Sumerinde and Yeny Magallanes Rodríguez, the facts for which eight leaders of the Front for the Defense of the Rights of the Town of Ayacucho (Fredepa).
Ramírez Cancho indicated that according to a document seized from the Senderistas in 2010, Fredepa is a front for the new Sendero Rojo and that its leaders have committed acts of terrorism by requesting that a constituent assembly be installed to dictate a new Constitution.
To prove these alleged acts of terrorism, the prosecutor mentioned police monitoring videos and audio tapping, where the detainees would coordinate filming videos of the marches to spread them on social networks and alternative media. Specifically, a video recorded, on January 15, 2023, with a drone of the burial of the victims of the repression in the marches in Ayacucho, is mentioned.
Likewise, having participated in conversations where there is talk of promoting a constituent assembly for a new Political Constitution of the State, which for the Prosecutor’s Office are terrorist acts of agitation and propaganda.

The provisional prosecutor exposed these facts before the appeals presented by the lawyers of Alex Gómez Falcón, Piero Giles Gamboa, Fernando Quinto Cuba, Yulisa Gómez Ayala, José Manay Pillaca, Clido Canales Tantaleán, Rocío Leandro Melgar and Estefany Alanya Chumbes.
The Chamber warned that there would have been confusion among the defense lawyers, since they filed appeals for annulment, when what they should have requested was the revocation of the judicial decision. If the resolution is annulled, the leaders would continue to be detained, since the revocation would leave them free.
The defense lawyers explained that they are requesting the annulment, since the judge did not duly justify his decision, since it cannot be considered that requesting a constituent assembly and a new Constitution is an illegal act. They noted that the possible error is due to the fact that they barely had two hours to appeal when the detainees were brought to Lima.
Alex Gómez, Piero Giles, Fernando Quinto and Yulisa Gómez denied being terrorists or having committed terrorist crimes.
