José Casañas Levi, a lawyer and professor of criminal law, stated that his first conclusion, about the case of a father of a family who ran over thieves to avoid a robbery, was self-defense.
“You have to verify if that was how the commissioner reported it. For it to be a case of self-defense, there needs to be an imminent aggression and to repel the aggression, the victim uses force or whatever is within his reach to avoid being harmed, ”he explained.
He finally argued that an investigation has to be opened because there is one person dead and another injured.
“In this type of case, when there is a lot of flagrancy, the best thing is that the prosecutor does not charge anyone, if he charges him with intentional homicide, the victim of the assault must remain in preventive detention. What corresponds is to carry out an investigation to corroborate that it was legitimate defense”, he concluded.
POLICE REPORT
The police report reads as follows; The National Police quickly went to the Vista Alegre neighborhood, after receiving a report of an attempted aggravated robbery, which according to the victims identified as: Yimi Alfredo Colmán (43) and Víctor Alfredo Roldán Rodríguez (22), two men who were traveling aboard a motorcycle, firearms were fired at him while they were riding in a vehicle, at which point the driver reacted and ran over the assailants.
One of them died at the scene, while the other identified as Luís María Vera Delvalle (34) was referred to a care center, remaining in custody; In addition, a firearm and a motorcycle were seized.
