First ministers of the eight resignations to the SCJN are presented

In the Supreme Court of Justice of the Nation (SCJN), the first two resignations of ministers of the eight announced were presented yesterday, and it is expected that the remaining seven will be formalized today, in the context of the judicial reform.

The first to be made public was that of Minister Alfredo Gutierrez Ortiz Mena, through a letter addressed to the president of the Senate board of directors, Gerardo Fernández Noroña, in which he highlights that This resignation does not imply a tacit acceptance of the constitutionality of the reform and that is not considered a suitable candidate for a position that depends on popular support.

And with the resignations – for consideration by the Senate – seven of their ministers automatically decline to participate in the 2025 electoral elections for judicial positions, a new method established by the reform of the Judicial Branch of the Federation (PJF).

Minister Luis María Aguilar is the only one of the eight aforementioned ministers who, even if he does not resign, could not participate in the electoral contest because on November 30 he will retire, upon completing the 15-year period in the Court for which he was appointed.

In the letter from Minister Alfredo Gutiérrez he highlights that his resignation is not an acceptance of the constitutionality of the reform, in force since last September 16.

I proceed in accordance with the presumption of validity that every rule deserves as long as it is not revoked by a competent court. But like so many things in the law, that presumption is provisional, fragile, and perhaps destined to disappear when the Court issues its final judgment. Until then I will follow the current ruleshe explains.

The letter recalls that on November 27, 2012, he accepted to serve as Minister of the Court and his position committed him to keep the promise of justice alive.

At night, the resignation letter of Minister Jorge Mario Pardo Rebolledo was released, who entered the Court on February 10, 2011. He stated that he was resigning after more than 40 years of judicial career, with a clean record.
