The renowned vallenato singer Nelson Velásquez has been sentenced to four years in prison for the crime of violation of author’s patrimonial rights and related rights. The decision was ratified by the Criminal Chamber of the Superior Court of Medellín, which confirmed the initial sentence issued in August 2024. According to the Attorney General’s Office, between 2012 and 2018, Velásquez interpreted several songs from the group ‘The restless Del Vallenato ‘, of which he was a vocalist between 1995 and 2004.

The legal action was undertaken by the legal representative of the Vallenata Group ‘the restless of the vallenato’, who argued that Velásquez, being the original voice of successes such as ‘never denies that I love you’ and ‘two crazy’, affected the heritage of The grouping when interpreting those and other songs without permission. In the first instance ruling, in addition to the prison sentence, a fine equivalent to 26 monthly legal minimum wages was imposed on Velásquez, however, the Court granted him the conditional suspension of the penalty, establishing a 48 -month proof period of 48 months , prior payment of a bond.

Velásquez’s defense appealed the decision, arguing that it had not been shown that the singer illegally commercialized the recordings or used the brand ‘The restless’. They also pointed out that it was not proven that LG Music, representative of the group, was the holder of the patrimonial rights of the songs in question. However, the Criminal Chamber of the Superior Court of Medellín ratified the conviction, based on the evidence presented by the Prosecutor’s Office that demonstrated the violation of copyright. 
Despite the conviction, Velásquez will not serve in prison, since he was granted the conditional suspension of the same. This means that, after paying a bond of approximately $ 37,011,000 pesos, the singer may remain released, as long as it meets the conditions imposed by the court during the 48 -month proof period.
