According to the calendar established for the anniversary withdrawal from the 2025 Severance Indemnity Fund (FGTS), workers born in January can, from this Thursday (2), withdraw the resources to which they are entitled. To do so, you must choose the modality in advance.
Aimed at establishing and preserving a financial reserve for the worker, the FGTS has been administered since 1990 by Caixa Econômica Federal. It is a right always guaranteed for everyone who signs a formal employment contract, governed by the Consolidation of Labor Laws (CLT).
Every month, employers must deposit the amount corresponding to 8% of their salary into a specific account for each employee. These resources can only be used in specific situations, such as in the case of unfair dismissal or by mutual agreement, acquisition of your own home, public calamity or retirement, among others.
The birthday withdrawal was established in 2020 as established by Federal Law 13,932/2019. The modality allows the worker to withdraw part of the balance from their fund account annually, in the month of their birthday. Membership is optional and must be done through the application or the FGTS websitewhere it is also possible to register a bank account to receive the amounts.
The amount available for the birthday withdrawal is calculated based on a rate that varies from 5% to 50% on the sum of all balances in the worker’s FGTS accounts, including active and inactive jobs. In addition, an additional installment is included, which can reach up to R$2.9 and depends on the available balance.
According to the calendar published by Caixa Econômica Federal, the birthday withdrawal is always available from the 1st working day of the month in which the worker completes another year of life. The deadline for withdrawing the amounts is two months. When opting for the birthday withdrawal, the worker automatically no longer has the right to the withdrawal-termination modality, in which it is possible to withdraw the full balance of the FGTS account in the event of dismissal without just cause.
Possible extinction
Last year, the Minister of Labor and Employment, Luiz Marinho, defended the extinction of the birthday withdrawal modality. He signaled on different occasions that the federal government would send a bill with this objective to the National Congress, which has not yet happened.
According to the Ministry of Labor and Employment, throughout 2024, more than 9 million workers dismissed without just cause had joined the anniversary withdrawal. In this way, they lost their right to withdrawal and were unable to withdraw the full amount of FGTS when they were terminated from employment. Marinho has considered that the birthday withdrawal modality distorts the function of the fund as a protection instrument in cases of dismissal.
In October, the minister even mentioned that he intends to propose mechanisms alternatives to the modality. “We want to debate with Congress to approve a proposal that guarantees accessible credit to workers, preserving the fund’s function as protection in the event of unemployment,” he said.
