The Specialized Prosecutor for Electoral Crimes of the Attorney General of the Republic (FGR) has failed to comply with the resolutions of the Electoral Court of the Judicial Power of the Federation (TEPJF) that ordered it to provide a copy of the files related to the Odebrecht case (and its possible connection with the financing of the electoral campaign of Enrique Peña Nieto) and the alleged irregular delivery of money to Pío López Obrador. Even when, in an incident of non-execution of sentence, he was instructed to make them available to the INE shortly
this is not yet fulfilled.
During the General Council session, Councilor Carla Humphrey criticized the fact that there are still authorities who claim to ignore that the institute is the only body responsible for overseeing the expenses of political parties as established by the Constitution. She stressed that despite the fact that the INE promoted an appeal before the TEPJF for the information to be delivered and the Superior Chamber endorsed the request, there has been reluctance, even when a 30-day period was set.
Even, he recalled, before a first omission, the electoral body promoted an incident of non-execution of sentence, which led to a second instruction from the TEPJF to the FGR to deliver the information shortly
. Humphrey stressed that these reticence of the prosecution hinder the work of the INE to investigate complaints related to the alleged irregular use of resources.
On his occasion, counselor Jaime Rivera mentioned that the impact of the prosecution’s attitude has been clearly reflected in the Odebrecht cases and in that of President López Obrador’s brother. In both cases, the institute has been insistent on requesting the information from both files, but ministerial secrecy has been appealed to deny it, something that the court has already determined is not appropriate in the case of the INE’s auditing tasks.
