The Minister of Justice, Felix Cheroannounced that the Executive would not recognize the result of the vote in plenary to reach the 87 votes required for the approval of the third presidential vacancy motion against Pedro Castillo Terrones. Faced with this eventual scenario, he announced that will resort to constitutional and supranational instances to defend the permanence in the position of the head of state.
“We have indicated that all constitutional and supranational channels will be used to defend what corresponds in a democracy in a constitutional State. It will have to be established that there is an imminent damage to constitutional rights and a precautionary measure will have to be instrumentalized via an amparo or a provisional measure before the corresponding international instances”, he declared to Exitosa.
Along these lines, the owner of the Minjus held that the third presidential vacancy motion presented by the non-grouped parliamentarian Edward Malaga Trillo it is full of vices and subjectivities that the figure of the presumed moral incapacity of the President of the Republic seeks to force.
“That’s right (we will not accept the result of the vacancy) and for a simple reason. What is intended with this third vacancy is to make a subjective hybrid of causes that have already been discussed in the first and second vacancy. In addition, they want to make inferences and legal qualifications of facts and apparent elements of conviction that have not been corroborated that correspond to the fiscal field. They want to build a permanent moral incapacity based on an investigation,” he added.
Along these lines, the president sent an official letter —last December 2— to the head of the board of directors, Joseph Williamsin order to return the third vacancy motion against him, given that it is incomplete: “I am pleased to address this to you in order to send you a cordial greeting and make the opportunity opportune to return the transfer of the Motion Order of the Day 4904 that contains the request for vacancy due to permanent moral incapacity, since in this it is incomplete.
Congress debates the vacancy motion
With a total of 73 votes in favour, 32 votes against and six abstentions, the Plenary of the Congress approved the third vacancy motion against the president Pedro Castillo for an alleged moral incapacity.
Furthermore, during the same plenary session it was agreed that, for this December 7 at 3:00 pm, the debate on said initiative takes place. 59 congressmen voted in favor, 45 against and a single abstention was registered.
Félix Chero: Congress does not allow the Executive to work

“Ministers are obliged to comply with what the Constitution rules, they can’t do whatever they want,” he told Exitosa.
