The Senate approved last night the minutes of the reform of the Customs Law, with changes to the first transitory article to defer until January 1, 2026 the entry into force of that legislation proposed by President Claudia Sheinbaum.
Due to the modification, this reform that toughens fiscal control measures and procedures for the importation of goods, in order to avoid corruption and stop tax evasion and avoidance, smuggling and in general the operations of organized crime in foreign trade, was returned to the Chamber of Deputies.
It was an accelerated legislative process, since just yesterday the Senate approved the minutes first in committees and then in plenary. This required waiving procedures and calling a second afternoon session, in which there were moments of hesitation, due to the insistence of PAN and PRI in accusing the federal government and Morena of being involved in the huachicol fiscal.
The minutes were approved by the plenary session in general with 78 votes in favor, 38 against and one abstention.
It was in the particular discussion that the Morena senator Homero García Davis presented a reservation to modify the first transitory article, so that the many changes to the Customs Law proposed by the head of the federal Executive do not come into force one day after their publication in the Official Gazette of the Federationbut until January of next year.
Early on, the president of the Finance Commission, Miguel Ángel Yunes Márquez, revealed that the tax authorities had notified him of this adjustment, requested by President Sheinbaum, and at night, García Davis specified that deferring its entry into force is due to the fact that the process of administrative, technological and regulatory adaptation requires time for its correct implementation.
“We are talking about a reform that will impact the country’s 50 customs offices, thousands of public servants and all foreign trade actors. Let us remember that the law establishes new processes, figures and responsibilities that must be properly regulated.”
It will be possible, he said, for the National Customs Agency of Mexico and the Tax Administration Service (SAT) to adapt their technological platforms, for foreign trade users to be trained and adopt the new procedures. Yunes Márquez, meanwhile, commented that there will be time for the regulations of that law to be ready, which has caused concern among customs agents.
Confrontation
During the debate, Morena and allies confronted the opponents, who placed cardboard on their seats with the legend “Huachicol Fiscal=Robbery of the Century,” and assured that the reform does not affect officials allegedly linked to fuel smuggling, which has caused damage of 600 billion pesos to the treasury.
In this environment, PAN member Lilly Téllez tried to have a video released in which the coordinator of Morena, Adán Augusto López Hernández, was accused of being involved with organized crime groups, which was stopped by the president of the Senate, Laura Itzel Castillo, who asked her to focus on the issue and, if she had evidence of her claims, present it to the Attorney General’s Office of the Republic.
The call huachicol fiscal does not exist, “what does exist is the illegal importation of fuels, which is what the Prian did” based on Peña Nieto’s energy reform, said Morenista Gerardo Fernández Noroña.
