Havana Cuba. — The Cuban regime has converted the new Family Code into law more than a month before submitting it to a referendum, a procedure scheduled for the coming September 25.
On August 17, the Law 156/2022 “Family Code” on the Official Gazette No. 87 Ordinaryapproved by the National Assembly of People’s Power.
In this way, the regime states that the popular vote will be worth nothing on September 25, the day the Code will be submitted to a referendum, unless it is to validate a process that is, in itself, anti-democratic.
The text has generated a lot of controversy, mainly on social networks, since its approval by the Cuban Parliament last July. The views are divided: some advocate Yes, especially those who defend the approval of “equal marriage”, others for No, mainly because they are against the greater interference of the State in families; and a third group advises not to participate in the referendum because “in a dictatorship you don’t vote.”
A referendum is a legal procedure by which laws or administrative acts are submitted to popular vote for approval.
At the end of the document it explains: “This Code is published in the Official Gazette of the Republic of Cuba for general knowledge” and that “it comes into force once ratified in the Popular Referendum.” However, a contradiction is generated, because with the publication in the Official Gazette the Family Code automatically becomes law, and would begin to be applied after ninety days.
With the publication of the Family Code in the Official Gazette, it is being assumed that the Family Code will be approved in the referendum. What would happen if it was not approved? Will it be removed from the Official Gazette? Will the popular vote be recognized or will it be manipulated?
This fact constitutes an act of hypocrisy on the part of the Cuban regime, which is also disrespectful to the citizenry. This demonstrates what many have warned on other occasions: that the draft was approved in advance and that the referendum is useless.
