Failure to comply with the Petro Government in parity laws could take Juan Carlos Florián from the Ministry of Equality

Failure to comply with the Petro Government in parity laws could take Juan Carlos Florián from the Ministry of Equality

Two demands aspire that the designation of Florián falls, because the cabinet no longer has women in 50% of its composition.

The powerful fifth section of the State Council received in its offices a Nullity action against Decree 0892 of 2025, with which President Gustavo Petro accepted on August 11 the resignation of Carlos Rosero and appointed Juan Carlos Florián as Minister of Equality almost a month after defending the official in a Council of Television Ministers.

Petro had claimed Rosero, Afro -Colombian leader and then head of the portfolio that Vice President France Márquez came out in the middle of a low budget execution, Because he was “throwing” officials who in his mayor’s office of Bogotá “demonstrated, at risk (…), their fight”. The former government exnegator with the ELN was in the Ministry since February 27.

“Me No one who is black will tell me that you have to exclude a porn actor that the union of sex workers created, “said the president, who admitted to having promised Juan Carlos Florián to be a vice minister. The political scientist worked as a vice minister of youth, and on August 1 the presidency published his resume as an aspirant to Minister of Equality.

Rosero presented his renunciation letter on the same day and made it public on August 2. Just over a week later, the president appointed Juan Carlos Florián, with an administrative act that will now enter into a litigation Administrative contentious. Judge Gloria Gómez Montoya will be in charge of reviewing the process, admitting it and presenting a presentation for the Quinta section.

The lawsuit, which filed the representative to the Catherine Juvinao Chamber, of the Green Alliance, questions that the government has breached Law 2424 of 2024, which establishes that women must lead at least half of the “maximum decision -making” positions in the executive branchlike the ministries, of which the presidency designates its holders.

In fact, President Petro himself signed this year A decree that, regulating the public function sector, remarks that 50% of the ministries, administrative departments, superintendencies, public service companiespublic societies for shares and other state entities must be women.

Appointing Florián, then, “not only implies the ignorance of a specific normative obligation, but also constitutes a structural affectation to the political rights of women, by depriving them of their right to participate in conditions of equity At the decision -making levels of the State, “says the nullity action, which already rests in the offices of the Minister and the Minister Gómez.

“The repeated and quantitatively demonstrable exclusion of women in the formation of the ministerial cabinet It cannot be understood as a simple individual omission, but as part of a systematic pattern which violates the principle of substantive equality and blocks the full exercise of the right to political participation, “insists the demand of Juvinao, of thirteen pages.

Failure to comply with parity rules did not begin with Florián, but with the Minister of Justice, Eduardo Montealegre. In May, when Ángela María Buitrago was still in charge of the law sector, the female participation in the cabinet was majority. Subsequently, the pattern broke, first with Augusto Ocampo as interim, then with Montealegre.

Therefore, according to the FM, in the Administrative Court of Cundinamarca there are Three nullity actions against Decree 647, which appointed former Minister General as Minister. The last one came first to the State Council, which was unmarked referring to the fact that the competence for the process corresponded to the court. The demand against Florián could run the same fate.

After the entrance of the former Magister of the Constitutional Court to the Government, President Petro “had The legal obligation of correcting the existing disproportion and restoring the balance required by the norm, “says the nullity against the Minister of Equity. The head of state did not do so, but appointed a manwhat “perpetuates” inequality in the Executive.

“The accumulation of normative omissions, the direct affectation of fundamental rights and the transgression of constitutional principles They show “that the administrative act that anointed the former porn actor” seriously violates the Colombian legal system “since “he ratified and deepened” the lack of a minimum threshold of 50% of women as ministers.

So far, the Government has not formally responded to demand. However, a question arises in the face of the manifestations that Juan Carlos Florián has made about his identity. In the ‘A hair’ podcast in mid -August he explained that He names himself in female and who prefers to call him “Miss Minister” instead of “Mr. Minister.”

“I name my female because I am a person and because I am a fag. I am not gay. I respect a lot and everyone has a way of self -defining. I am a fag and that’s why I speak in female“Florián said in his interview. The main question in the future is: Will the minister transform that argument into a legal discussion? Justice will have the last word.

In the Administrative Court also a nullity action of Juan Manuel López Molina against Florián’s decree. The demand coincides with that of Juvinao by warning that the Petro administration has 52.6% of men as members. “This is unreasonable and disproportionate in the light of higher norms”says López’s text, twenty -four pages.
