Fachin takes office in the presidency of the STF on Monday

Minister Edson Fachin takes office on Monday (26), at 16h, in the position of President of the Supreme Court (STF) for the next two years. The vice president will be Minister Alexandre de Moraes. Fachin takes office in the presidency of the STF on Monday

The new president will succeed Luís Roberto Barroso, who will complete the two -year term at the head of the court.

Fachin’s election for office took place last month and was made symbolically.

Currently, the minister is the vice president, and, by the seniority criterion, must take office. According to the Rules of Procedure, the court must be commanded by the oldest minister who has not yet chaired the court.

President Luiz Inácio Lula da Silva, Vice-President, Geraldo Alckmin, and the presidents of the Chamber of Deputies, Hugo Motta (Republicans-PB), and Senate, David Alcolumbre (Union-AP), as well as other authorities were invited to the inauguration.

Fachin dismissed the traditional inauguration party, which is bench by magistrate associations and offered to all ministers who reach the Supreme Court or assume the presidency.

Guidelines

For having more contained personal profile, Fachin should avoid controversial statements in the press and clashes with politicians. According to people close to the minister, the new president should stand out for the conduct of judgments with great social impact.

Next Wednesday (1st), when the first session will be held under the command of Fachin, the Court will start the trial on the employment relationship of drivers and application delivery, the so-called “uberization”.

Profile

Nominated by former President Dilma Rousseff, Edson Fachin took office in the Supreme Court in June 2015. The minister was born in Rondinha (RS), but made a legal career in Paraná, where he graduated in law from the Federal University of Paraná (UFPR).

In the Supreme Court, he was a rapporteur for investigations of Operation Lava Jato, the temporal framework for indigenous land demarcations and the case known as ADPF of the favelas, an action in which several measures were adopted to reduce police lethality during operations against drug trafficking in Rio de Janeiro.

Rapporteur of the criminal plot’s criminal actions, Alexandre de Moraes is a graduate of the Faculty of Law of the University of São Paulo (USP). The minister was sworn in in March 2017.He was nominated by former President Michel Temer to succeed Minister Teori Zavascki, who died in a plane crash that year.

Before arriving at the Supreme Court, Moraes also held several positions in the government of São Paulo, where he was Secretary of Public Security and Transport. He was also Minister of Justice in the Temer government.
