The alleged drug trafficker Carlos Silva Arellano lost the protection he promoted before the Supreme Court of Justice of the Nation (SCJN) to avoid his extradition to the United States.
According to investigations by the US Drug Enforcement Administration (DEA), the defendant is a relevant member of the poster of the Beltrán Leyva family.
Unanimously, the ministers of the first chamber denied the petition of the accused against the negotiation, celebration, ratification, approval, endorsement and publication of the Extradition Treaty between the United Mexican States and the United States of America

The approved draft judgment was presented by Minister Juan Luis González Alcántara Carrancá, and it upholds the constitutionality of said bilateral agreement.
What the Mexican State agreed was an international commitment to deliver to the individuals who are required when the conditions stipulated in that instrument are met, but in accordance with domestic law, in the case of the procedure aimed at that end, the means of jurisdictional control are contemplated. necessary to guarantee the defensive and evidentiary opportunity of the accused, as well as the due legal process that in his favor are protected by articles 14 and 16 of the Constitution

Silva Arellano, aka The Balls, responded directly to the brothers Juan Pablo and Juan Francisco Patrón Sánchez, then leaders of the poster Beltrán Leyva, says the DEA.
The case against him is processed in the Federal Court for the Eastern District of New York – the same one where Joaquín was tried. El Chapo Guzmán Loera–, for crimes against health, criminal association and carrying a firearm.
Once the protection was denied by the SCJN, the file was returned to the fourth collegiate court in criminal matters of the first circuit, to decide according to the directive of the ministers and authorize the extradition of Silva Arellano, to be tried in the United States by the referred offenses.
