A provisional measure (MP) was published on the night of this Friday (31), in an extra edition of the Official Journal of the Union, which changes the date of repeal of Law 8666/93, of the Differentiated Purchasing Regime (12462/2011) and of the Trading Law (10,520/21). In this way, municipal managers will have until the last working day of the year to adapt to the New Bidding Law. Until then, the old modalities can still be used.
The MP meets a demand from mayors. The old bidding models would remain valid until today. With the postponement, the bodies and entities of the Federal, State or Municipal Public Administration will still be able to publish notices in the old hiring formats until December 29, 2023.
The Minister of Management, Esther Dweck said that in May the National School of Public Administration (Enap) will carry out training for public managers focused on the new legislation.
According to the government, the New Bidding Law unifies all previous legislation, in addition to bringing more transparency, effectiveness and agility to bids and the execution of administrative contracts.
Among the changes are the creation of new bidding modalities, such as the competitive dialogue and the auction, the adoption of the trading session in all spheres of Public Administration; the creation of the Federal Government Procurement System (Compras.gov.br), among others.
