Ernestina Godoy remains as interim prosecutor after the departure of Gertz Manero

This move was made because the law establishes that the ownership of the Attorney General’s Office will be temporarily occupied by the head of the Specialized Prosecutor’s Office for Competence Control.

Senators consulted from Morena already knew that Ernestina Godoy, former Legal Counsel, would be the person who would remain in charge of the FGR while the selection process was carried out.

Given this appointment, Ernestina Godoy went to the Senate today to meet only with the legislators of Morena and allies, where she outlined her way of working for the days she will be in charge of the FGR.

Assuming the interim position does not prevent Ernestina Godoy from participating in the process to select the new permanent prosecutor.

Who is Ernestina Godoy?

Ernestina Godoy is originally from Mexico City. She was born in the Cuauhtémoc mayor’s office on January 17, 1954. She is a lawyer who graduated from the UNAM Law School.

She has been the founder of various civil organizations and public advocacy platforms of civil society, such as the National Association of Democratic Lawyers, Convergence of Civil Organizations for Democracy and Civic Alliance, among others.

He served as a representative of Civil Society in the Commission for Monitoring and Verification of the San Andrés Larrainzar Agreements signed by the EZLN and the federal government. As a public servant, she held various positions from 2000 to 2012, and was also a local representative, as well as a federal representative from 2015 to 2018.

In December 2018, Godoy was appointed attorney general of Mexico City, and remained in office during the transition from the Attorney General’s Office to the Prosecutor’s Office, with which the institution became independent of the Executive, thanks to a reform to the capital’s Constitution to change the requirements that prevented her from being elected, named by the opposition in the local Congress as ‘Godoy Law’, in 2019.

In January 2024, the capital’s Congress did not ratify her as a prosecutor. But in June of that same year, she was elected as senator, in the formula she shared with Omar García Harfuch.

Finally, once in power, Claudia Sheinbaum appointed her as her legal advisor.

Call to elect prosecutor begins

After accepting the resignation of Gertz Manero, the Senate started the call to elect the next head of the FGR. For this reason, he called on those interested in aspiring to this position to present their request to the Senate by electronic means starting tomorrow, Friday, November 28 and until Sunday, November 30.

Applicants must present the following documents:

– Application where the willingness to participate in the process is expressed.
– Curriculum Vitae with photography.
– Signed document stating that you have not been convicted of an intentional crime.
– 10-page essay on the analysis of the criminal phenomena that affect the country.
– Copy of birth certificate, voting credential, professional degree in Law with at least 10 years’ experience, professional license.

Subsequently, the Political Coordination Board (Jucopo) will validate the registration and verify the files to select at least 10 people and will put them for consideration by the Senate Plenary so that it can be voted on and accepted by two-thirds of the senators present.

Once approved, the list will be sent to the Executive Branch, where President Claudia Sheinbaum will choose three people.

These people will appear in the Senate before the Plenary Session of the Senate separately. And at the end, the senators will vote for each one by means of a ballot, which is by placing a piece of paper in a ballot box.

The person with the most votes in favor will be designated as head of the FGR.
