Enrique Márquez files appeal to the TSJ against ruling on June 28 results

Former candidate Enrique Márquez said that he has had “conversations” with some of the parties that make up the Unitary Platform. “Of course we have similarities and concerns about the future of the country. This is not an isolated action. It is an action that complements the others, inside and outside the country, seeking precisely a political solution.”

The former presidential candidate for Centrados, Enrique Marquezfiled this Wednesday, July 25, an appeal for review before the Constitutional Chamber of the Supreme Court of Justice (TSJ) regarding the ruling that validated the results of the presidential elections of July 28, where Nicolás Maduro was declared the winner.

“We are here without being innocent, because we are very convinced of the value of our Constitution and the rule of law (…) This is a resource that we are sure can open the door to the future. It can open doors to constitutionality.“Márquez said at a press conference outside the Supreme Court.

He explained that the appeal requests the annulment of the Electoral Chamber ruling 032 for the “vices of unconstitutionality” and the lack of respect for the popular will expressed at the ballot boxes. In addition, they seek “certainties” about the results of July 28 because, unlike the sector led by María Corina Machado and Edmundo González, they do not have voting records.

“We ask the judges of the Constitutional Court not to dismiss it, to analyze it carefully because they are, perhaps, the last line of defense of the Constitution and they must act accordingly. So with doubts, with fears, with inaccuracies, we are here because, after all, the best way to defend institutions is to use them, the best way to defend rights is to exercise them,” he stressed.

He also hopes that this document, endorsed by different fronts that bring together the original Chavismo and parties such as the PCV, MAS or Centrados, “will be the banner of a civic movement. Both the CNE and the Electoral Chamber have only contributed to the uncertainty. We are asking for the results to be published and for the processes to be respected.”

Enrique Márquez commented that, according to the Court’s secretariat, a judge should be assigned within five working days to decide whether the request for review is admissible. If the response is positive, the Court would then proceed to decide on the merits of the matter and decide on it.

He ruled out anticipating the scenario where his application is declared inadmissible and subsequent actions. “We will get to the bridge first.”

Regarding his confidence in the institutions, he said that it is better to try to appeal, although he pointed out that the Attorney General’s Office has not yet responded to an appeal he filed to investigate the directors of the National Electoral Council.

“We are going to continue on the institutional path, which is what we all support here, in a response from the institutions in a time of crisis,” Márquez insisted.

Márquez also said that he has had “conversations” with some of the parties that make up the Unitary Platform. “Of course we have similarities and concerns about the future of the country. This is not an isolated action. It is an action that complements the others, inside and outside the country, seeking precisely a political solution.”

He also said that the government of Nicolás Maduro “could be in more trouble than it thinks” and rejected the repression “especially against the youngest and poor families.”

“On July 28, something happened that the entire Venezuelan people saw: the people want a change in this country. The government pretends not to listen to that voice (…) We would advise them to walk in the direction of strengthening democracy and the Constitution instead of walking towards the abyss, which means more authoritarianism, more totalitarianism,” he stressed.
