The National Agency for Public Procurement Colombia Efficient Purchase announced that decree 1082 of 2015 was modified, changes that seek to position a new approach to contracting and allow for an inclusive, socially responsible, environmentally sustainable, transparent public purchase that promotes the participation of popular economy actors in state contracting.

According to the director of Colombia Compra Eficiente, Stalin Ballesteros, the idea is that public entities from the first moment of their purchase divide their processes by segments in order to reduce the requirements and promote the participation of MSMEs.
According to the state agency, in addition to this, an inclusive catalog will be created for the purpose of acquiring goods and services with uniform and non-uniform technical characteristicswhich can be provided by associations of small local producers and local agricultural producers whose production systems belong to peasant, family and community agriculture.

The decree will have thematic axes to expand the offer in state entities: Environmental, MSMEs, Solidarity Agreements, eliminate access barriers and aggregation instruments.
1. Enables public entities to incorporate social and environmental criteria in the selection processes.
– Through the inclusion of these criteria in the selection processes, the behavior of economic agents is oriented to favor the fulfillment of non-commercial objectives, which allow the development of an economy based on the sustainable use of natural resources and implement better production standards, environmental and social.
2. Promotion of the participation of MiPymes in the public purchasing market.
– It tends for public entities to divide their contracting processes by segments, in order to promote the participation of MiPymes in said processes.
– Enables public entities to include mechanisms and rules in the specifications that limit the number of segments to be awarded to the same bidder with the purpose of democratizing public procurement.

– The defined segments can be limited so that MiPymes exclusively participate so that they are awarded the contracts entered into by the State Entities.
3. Celebration of Solidarity Agreements with actors of the Popular Economy for the democratization of public procurement.
– A new title is incorporated into Decree 1082 of 2015, through which measures are adopted that facilitate the signing of solidarity agreements with community action organizations.
4. Implement mechanisms to overcome access barriers to the public procurement system to promote the participation of actors from the popular economy.
– Inclusive business fairs are created as a non-obligatory instance of market consultation, to identify access barriers in the contracting processes by the actors of the popular economy.
5. Design of instruments by Colombia Compra Eficiente that guarantee the participation of actors from the popular economy in the public procurement system.
– Establishes the possibility for the Agency to develop demand aggregation instruments aimed at popular economy actors in order to eliminate intermediation and indirect costs in acquisitions made by public entities.
With this new decree, the government of change takes a step towards inclusive contracting and opens the doors to new actors in the public procurement system through Colombia Compra Eficiente.
