The Joint Commission of the National Congress that analyzes the Provisional Measure (MP) 1300/25 approved on Wednesday (3) the proposal that changes the Social Tariff of Electric Energy (TSSS). The text exempts low -income families of the light bill in cases of low consumption.
The MP still needs to be voted in the plenary of the House of Representatives and the Senate to be permanently apparent.
The social tariff began to apply in early Julywhen the MP was edited by the federal government. The gratuity goes for families benefiting from the Federal Government’s Single Registry for Social Programs (CadÚnico) and who have a monthly consumption of up to 80 kilowatts (KWh).
According to the government, the benefit will grant the total free light bill to 4.5 million families. Another 17.1 million families who are also entitled to social fare will not need to pay for the first 80 kilowatts-hours (KWh) consumed each month.
Rules
By fare rules, approved by the National Electric Energy Agency (ANEEL), consumers benefited by the social tariff have three -phase facilities and use up to 80 kWh per month are free to free.
In this case, only the costs not associated with the energy consumed, such as the contribution of public lighting or the tax on the circulation of goods and services (ICMS), in accordance with specific legislation of the State or Municipality where the family resides, may be charged on the invoice.
For consumers who have three -phase facilities and use over 80 kWh per month, the network availability cost remains 100 kWh. In this case, the consumer will need to pay a difference if it uses between 80 kWh and 100 kWh.
The availability cost is the minimum amount charged by the distributor to remunerate the expenses with the power grid to transport the energy to the consumer.
Who is entitled
The text approved by the Commission maintains the total exemption of the light account for low -income families and the exemption of the Energy Development Account (CDE) for Families of the Single Registry with income between means and one minimum wage, in the consumption of up to 120 kWh per month.
In order to be a beneficiary of the electricity rate of electricity you need to fit in one of the requirements below:
- Family registered in the Single Registry, with monthly per capita family income smaller or equal to half a national minimum wage;
- Elderly 65 years or older or disabled people who receive the continued benefit of social assistance (BPC) and are in the Single Registry;
- Family registered in the Single Registry with monthly income of up to three minimum wages, who have a person with illness or disability (physical, motor, hearing, visual, intellectual and multiple) whose treatment, medical or therapeutic procedure requires continued use of devices, equipment or instruments that, for their operation, require electricity consumption.
- Also entitled to benefit are indigenous and quilombola families registered in CadÚnico, whose monthly consumption is up to 80 kWh/month.
Automatic grant
The social tariff is automatically granted to families who are entitled. To receive, it is sufficient that the person responsible for the electricity supply agreement (the one whose name is in the invoice) is among those benefited by the government programs described above. Therefore, it is not necessary to request the distributor.
The MP also brings other measures, such as different rates by consumer hours, prepaid energy supply, different types of fare according to location and complexity.
Rapporteur Fernando Coelho Filho (União-PE) explained that he chose to limit the report to the social tariff. The themes about the opening of the energy market will be discussed at MP 1304/25, which deals with the reduction of tariff impacts.
According to the deputy, the decision was the result in accordance with the presidents of the House and Senate. He stated that the 600 amendments rejected in the MP 1300 analysis will be considered in the new debate.
“I would like this MP to deal with many other topics. But this text was the possible and I want to believe that we will include other points in MP 1304,” he argued.
The National Congress has a deadline until the beginning of November to approve the MP so that it does not lose the validity.
