Electricity Industry Law does not violate free competition: Loretta Ortiz Ahlf

According to the minister, “it is observed that the objective of the challenged regulations is not that the State becomes the sole generator and marketer of energy.”

The foregoing, given that the objective is “to establish specific measures for the benefit of the collective interest and guarantee the reliability of the National Electric System, through the modification of the criterion of economic dispatch of energy.”

“The Mexican State must ensure comprehensive and sustainable national development, strengthening the Sovereignty of the Nation and its democratic regime and that, through competitiveness, the promotion of economic growth and employment, and a fairer distribution of income and wealth, allows the full exercise of freedom and dignity of individuals, groups and social classes”, refers to the text.

Similarly, the minister makes it clear that the Legislative Power was endowed with full freedom of configuration, especially considering that the State must guarantee access to electricity, both as a service and as a human right, “which proves beyond doubt doubts, that the reforms in question serve a public interest that should prevail over the interests of individuals”.
