The Electoral Justice recalled that the political organizations are obliged to comply with the term of the propaganda established in the electoral schedule, with a view to the simultaneous internal ones, otherwise they could be sanctioned.
The Superior Court of Electoral Justice (TSJE) communicated that political organizations are obliged to comply with the deadline for electoral propaganda set forth in Art. 290 of Law 834/1996, which establishes the Electoral Code.
According to the electoral schedule for the general elections, for the simultaneous internal ones, the dissemination of plans and pre-candidacies can be carried out from November 16 on public roads and from December 6 in the media.
To this end, the political parties may carry out electoral propaganda on public roads from the aforementioned date, to disseminate their proposals for candidates or programs for elective positions through the display of parades, graffiti and posters.
Likewise, for the dissemination of electoral propaganda through mass media of social communication for simultaneous inmates, messages may be published in radio, television or written media with proposals for candidacies or government programs, from 6 December until December 16, 2022, as indicated in item 55, of Res. TSJE No. 108/2021.
In this way, candidates can avoid sanctions by respecting the deadlines established for carrying out political propaganda on public roads and requesting the corresponding permit from the municipalities where said propaganda will be carried out, provided for in Articles 291 and 292 of the Electoral Code. .
In this sense, Articles 294 and 295 of the Electoral Code establish that the municipalities must indicate the sites enabled for carrying out electoral propaganda. It is appropriate to mention that it is prohibited to make electoral propaganda, on bridges, public buildings, monuments, traffic signs or pavements, according to Art. 296 of the Electoral Code.
The municipalities are the ones empowered or in charge of establishing fines for cases of non-compliance with the regulations of electoral propaganda on public roads extemporaneously.
In this context, the Central Electoral Prosecutor’s Office sent requests to the municipalities of San Lorenzo and Luque to withdraw the extemporaneous electoral propaganda identified in the aforementioned cities.
