Electoral Court orders the INE to sanction Quadri for discrimination

The Superior Chamber of the Electoral Tribunal of the Judicial Power of the Federation (TEPJF) ordered the National Electoral Institute (INE) to promptly issue precautionary measures against federal deputy Gabriel Quadri, so that he refrains from publishing or issuing pronouncements that may be discriminatory against transgender people. This, derived from a complaint filed by the legislator Salma Luévano.

In a private session, the plenary session partially revoked, by majority vote, the agreement issued by the INE Complaints and Denunciations Commission, which declared the request for the adoption of precautionary measures presented by Luévano inadmissible, given alleged acts of violence against him. gender policy for her identity as a transgender woman, due to various publications made by Quadri on social networks.

The INE considered that the existence of of an urgent and imperative necessity that justified the measures, and that the political-electoral rights of a person or a group were not violated.

Luévano challenged and argued that the expressions were directed at her person and constitute discriminatory messages that generate hate speech against the trans community. What’s more, they have the objective of limiting their right to vote, in its modality of free exercise of the position, since what the federal deputy intends is to stop the initiatives that are presented in terms of inclusion and recognition of the rights of the LGBT population.

The Superior Chamber revoked the appealed determination so that the INE issues a new one in which it issues precautionary measures so that Quadri withdraws some of the denounced Twitter messages and refrains from publishing or issuing identical or similar and discriminatory pronouncements.

Luévano shaved his head on January 10 in protest at the transphobic statements of the PAN legislator. In addition, he filed a complaint with the Ethics Committee of the Chamber of Deputies.
