Elections in San Marcos: Ruth Shady's candidacy should not have been crossed out

The archaeologist and anthropologist Ruth Shadyrecognized in the world for its work of conservation and dissemination of the archaeological complex of Caral, should not have been crossed out in the elections of the National University of San Marcos (UNMSM), which will take place from this Friday, October 18, 2024, and therefore the list it includes should also remain in force.

It was held by Dr. Jairo Cieza Moralawyer of the Convergencias list and of the candidate for dean of Social Sciences, Professor Carlota Casalino.

In his legal report, Cieza Mora maintained that Shady’s case does not constitute immediate re-election and “it does not contravene any rule, since it is not within article 5 of the Regulations or article 89 of the UNMSM Statute, as it is not an immediate election. And, secondly, if this is the case, the University Law does not prohibit immediate re-election for members of a collegiate body,” he concludes.

And he warns that, for this reason, the Convergencias list, on which the archaeologist nominated, is also “fit to participate in the elections of deans at the UNMSM.”

Links with the rector

Shady is on the Convergencias list as a candidate for Faculty Advisor in Social Sciences. The person who filed the complaint against her was none other than the candidate for dean Pedro Jacinto, on the list opposing Shady.

Convergencias had already warned that they were seeking to affect Shady’s candidacy and cross out the entire list in the Faculty of Social Sciences. “This cunning style, based on tricks and shortcuts, shows us the true nature of the candidate,” the aforementioned list said in a public statement, adding that Jacinto has “strong ties from the highest authorities of the university,” alluding to the rector Jeri Ramon.

At this point, Cieza Mora comments: “The list against Shady is linked to Dr. Jeri. It happened in Literature, Law… I think that the rector’s idea is to take over the bodies of the University Assembly and deans who adhere to her line. That is why practically only one list competes.”

Immediate re-election

The complaint filed indicated that Shady had already been elected as Faculty Advisor in a previous period (2020-2024). But her defense has maintained that she left the position of main professor in the Faculty Council of Social Sciences because she was dismissed due to age limit. A new rector’s resolution reinstated her, but as an ordinary teacher, she did not resume any position.

“That is our first central argument: that in the case of Dr. Shady there is no immediate reelection, because for it to be immediate there must be continuity, she has never held any continuity in office, because her age position was made in 2022 and then he never took it up again,” says lawyer Cieza to The Republic.

Furthermore, Cieza specifies that Law 30220, University Lawestablishes in its articles 66, 67 and 68 the non-immediate re-election of rectors, vice-rectors and deans. “Therefore, the articles of no immediate re-election do not apply to the positions of teacher representatives.”

The elections, despite the irregularities reported in these elections for the University Assembly and the deanships, will be held this Friday the 18th.

“Regardless of the fact that the election is on Friday, the validity of the elections can be questioned, because the rights of Dr. Shady and therefore those of the list have been violated. It is already known that the rector’s list, which is going alone, will win, but that result can be questioned, because there is an obvious impact on Dr. Shady,” concludes Cieza Mora.

Questioned university elections

-This Wednesday, due to the questions, the ONPE issued a statement informing that it resumed technical assistance, but “if we notice irregularities, we could cancel our participation, even during election day.”
