The Criminal Chamber of the Supreme Court of Justice (TSJ) ratified the maximum penalty sentence (30 years) imposed on Johander Gabriel Gutiérrez Valbuena (23), alias El Chupi, who was found guilty of the crime of sexual violence committed against a 15-year-old girl.
The judicial decision is reflected in ruling No. 40 issued on February 12 with the signature of the three magistrates who are members of the Criminal Chamber: Carmen Marisela Castro (editor or speaker), Elsa Gómez and Maikel Moreno.
The events occurred at the victim’s residence located on 13th Street, San Sebastián neighborhood, Maracaibo (Zulia) at 5:50 am. The subject broke into the victim’s room, where she was sleeping with her cousin. “I felt that someone fell on top of me on the bed; when I turned to see who it was, he was hooded; at once he covered my mouth and pointed a gun at my head. I told him that if I wanted him to take the entire house, but not to hurt me, and he told me that he was coming for me, that he was not coming for the sake of it; he told my cousin to move to the other bed and he started touching my private parts, he abused me,” the victim told the police authorities.
Once the abuse was committed, the subject pointed the gun at the victim’s cousin and told him to get the keys to the house. The boy looked for them and the criminal opened the door and locked them in the room to flee, taking the young woman’s cell phone and a sound horn.
Eight days after that event, alias El Chupi was arrested by police officers from the Maracaibo municipality, who were patrolling in the San Sebastián neighborhood, where the rape occurred.
The trial against El Chupi began on January 15, 2024 and ended on October 3 of that year, the day on which he was found guilty of the crimes of sexual violence and aggravated robbery, among others. This sentence was ratified by the Court of Appeals of Zulia, as well as by the Criminal Chamber of the TSJ.
