Edmundo Jacobo resumes as executive secretary of the INE after dismissal

When celebrating his return, the president counselor, Lorenzo Córdova, affirmed that with the definitive suspension “an act of justice is carried out that restores an upstanding, honest and committed official here in the electoral system and democracy owes him a lot” .

More than a restitution of rights, Córdova highlighted, the autonomy of the INE was defended, since the executive secretary is elected by eight votes of the General Council “and no State power can remove him, much less the Legislative Power, unless it is through a political trial “.

Córdova highlighted the reasons why Jacobo’s reinstatement was granted: the judge noted “reasons that point to the unconstitutionality” of “Plan B” and because reassuming the position does not cause an impact on social interest.

“The undemocratic and unconstitutional legal changes of the so-called Plan B have suffered their first legal setback, the first, I’m sure, of many to come,” he celebrated.

The reinstatement in office, according to the agreement issued by Judge Blanca Lobo, of the Twelfth District Court, is only for the exercise of the functions established in the electoral reform still in force, that is, with powers limited by Plan B.

“In the understanding that the granting of the measure only affects the permanence in office, not the way in which he must carry out his duties. Since for this it must adhere to the current legal framework ”, according to the resolution.

The effect “will be that he be restored to the enjoyment of his prerogatives and rights as well as to continue exercising his powers as executive secretary.”

And in what capacity does the dismissed official return?

Executive Secretary Edmundo Jacobo said in an interview that although he returns to office, it will eventually suffer modifications derived from what is ordered by “Plan B”, if it remains in force.

“Step by step, first I am returning, the General Council will have to start all the work that it has to do (for the restructuring) and the General Council is the one that will decide my future eventually” because most of the directors could agree to an eventual departure from office.

Lorenzo Córdova, president counselor, stressed that according to the judicial resolution “the executive secretary continues to be executive secretary” until the electoral reform is implemented.

The transitory of the reform have a term for the implementation of the changes and all the effects will occur until the month of August, he recalled.

But before that term, the counselor Ciro Murayama anticipated “we are facing the chronicle of an announced declaration of unconstitutionality” for which he trusted that “Plan B” will not apply nor will the restructuring of the INE materialize.
