Environmental organizations, grouped in the association Nuestro Futuro, delivered to the Supreme Court of Justice of the Nation (SCJN) a amicus curiae –a text with legal arguments, presented by a third party that is not a direct party to the trial– against the constitutionality of the Electricity Industry Law (LIE), whose discussion in the highest court will begin this Tuesday.

Meanwhile, the highest court acknowledged receipt of the request from opposition senators for minister Loretta Ortiz Ahlf to excuse herself from participating in the analysis of the LIE, arguing that as a deputy she voted against the electricity reform. This request will be voted on before the plenary session of ministers enters into the substantive discussion of the matter.

The members of Nuestro Futuro oppose the projects presented by the minister, which propose to endorse the LIE based on the argument that the social interest is above the individual, for which the State must exercise its powers to guarantee the service electricity, access to which is a human right.

For the director of this association, Nora Cabrera Velasco, Ortiz’s proposal leaves aside the environmental aspects of the issue and it is necessary to review it so that it includes public policies in order to combat climate change.

“It is a very important document because it is signed by many organizations and it is one of the few amicus that was presented in relation to the electrical industry; We believe that the ministers should put climate change at the center of the debate, and how in Mexico we have to face this phenomenon, what we want is a constitutional climate precedent where the ministers recognize that we have the right to have serious policies , effective climate change mitigation policies,” said Cabrera.

It is not about ideologies, it is about putting the consequences for the environment at the center of the debate. He announced that they will demonstrate this Tuesday before the headquarters of the SCJN against the ministers endorsing the LIE.
