The president of Ecuador Daniel Noboa declared this Friday a state of emergency in the country.
The measure is due to the “internal commotion and public calamity” caused by the energy crisis that their country is experiencing.
The objective of the State of Exception is to guarantee the continuity of the electrical service on a national scale.
decree: Declare a state of exception due to serious internal commotion and public calamity, throughout the national territory, caused by the emergency in the electrical sector in order to guarantee the continuity of the public electrical energy service.
This declaration is based on the factual situation described in the considering part.
of this Executive Decree that expose the emergency situation in the electricity sector and the need to adopt urgent measures.
This declaration requires an emergent and urgent intervention by State institutions to protect and guarantee the provision of the public electric energy service, responding to the principles of obligation, generality, uniformity, efficiency, responsibility and universality.
Article 2.- The declaration of a state of emergency due to serious internal commotion and public calamity, throughout the national territory caused by the emergency in the electricity sector, will be valid for sixty (60) days.
This deadline is based on the need to have adequate time to overcome
the factual facts raised, address the energy deficit and guarantee the supply
of the electricity service in the present, tending towards stabilization in the future
immediate.
Article 3.- The Ministry of Economy and Finance will allocate sufficient resources to address the present state of emergency due to serious internal commotion and public calamity necessary for this purpose, except those corresponding to health and education.
Article 4.- Provide for the mobilization and intervention of the National Police and the Armed Forces throughout the national territory, duly coordinated, to guarantee the security of critical energy infrastructure facilities to prevent sabotage, terrorist attacks or other threats that may affect their functioning.
Article 5.- The Ministry of Energy and Mines is responsible for the execution of this Executive Decree. Ministry of Economy and Finance, Ministry of National Defense; and. Ministry of Interior.
Article 6.- Notify of this declaration due to serious internal commotion and public calamity, throughout the national territory caused by the emergency in the electricity sector, to all the corresponding entities in accordance with the constitution and the law.
